BonJourno Terms of Service

1. Who We Are and These Terms
BonJourno is operated by Fanbase Technology Co. ("BonJourno," “Fanbase,” "we," "us," or "our"). These Terms govern your access to and use of bonjourno.com, the BonJourno mobile applications, and the related features, content, and services we provide (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy. The Privacy Policy explains how we collect, use, store, and share information. If you do not agree to these Terms or the Privacy Policy, do not use the Services.
2. Eligibility (18+)
You must be 18 years of age or older to use the Services. The Services are not directed to minors, and minors may not create accounts or access any part of the Services.
If you use the Services for an organization, you represent that you are authorized to accept these Terms for that organization.
3. Accounts and Account Security
You must provide accurate information and keep it current. You are responsible for protecting your credentials and for all activity performed through your account. Notify us promptly at support@bonjourno.com if you believe your account has been compromised.
You may sign in with an email and password or, where available, with Google or Apple. Third-party sign-in is governed by the relevant provider's terms. We may require email confirmation before you publish content, sign a petition, or use features requiring verified identity.
We may rate-limit, suspend, or restrict access where reasonably necessary to protect users, the Services, or legal rights.
You are responsible for securing your own devices and ensuring they are free of malware or unauthorized access.
4. What the Services Provide
The Services allow users to:
- create profiles;
- publish and discover articles, audio, video, links, and RSS content;
- comment and react;
- follow users and topics;
- create or join communities;
- communicate through direct, group, community, and support chats;
- create forms and link pages;
- create and sign petitions;
- submit reports;
- use optional AI-assisted writing and image tools.
Features may differ between the website, iOS, and Android. We may add, change, suspend, or discontinue features. We do not guarantee that any feature or content will always be available.
We do not guarantee uninterrupted access to the Services. Outages, maintenance, or technical issues may occur.
5. User Content and Your Responsibility
"User Content" means content you submit, publish, upload, send, or otherwise make available through the Services, including text, articles, comments, audio, video, images, profile information, messages, petition content, form content, links, and AI-assisted output.
You retain ownership of your User Content. You are solely responsible for it and represent that:
- you own it or have all permissions necessary to use and share it;
- it does not violate copyright, privacy, publicity, confidentiality, contractual, or other rights;
- it is not unlawful, fraudulent, defamatory, threatening, harassing, hateful, exploitative, or deceptive;
- it does not contain nudity or sexual content (including AI-generated nudity or synthetic sexual imagery);
- any factual, journalistic, medical, financial, legal, political, or other claims you publish are your responsibility.
Do not upload confidential information, passwords, authentication codes, private keys, seed phrases, government identifiers, payment-card data, or another person's sensitive information unless a Service feature expressly requires it and you are legally authorized to provide it.
You are responsible for backing up your own content. BonJourno is not responsible for loss of data.
6. License You Give BonJourno
You grant BonJourno a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt for technical formatting, display, distribute, and make your User Content available as reasonably necessary to operate, secure, improve, promote, and provide the Services.
This license includes displaying your chosen name, channel name, profile, or byline with your content; creating technical copies, previews, excerpts, thumbnails, feeds, and accessible formats; and distributing your content through features you select, such as sharing tools, RSS, community feeds, and external links.
The license ends when your User Content is deleted from active systems, except to the extent that:
- another user has shared or incorporated it into a permitted interaction that remains available;
- retention is reasonably necessary for safety, abuse prevention, dispute resolution, legal compliance, or backups; or
- applicable law requires retention.
BonJourno does not obtain ownership of your User Content. However, if you choose to publish under the “Anonymous” or “Decentralized Press” byline, you acknowledge that you are intentionally assigning authorship and ownership of that submission to Prose and Cons Media Literacy Fund, a Pennsylvania 501(c)(3) organization that operates the Decentralized Press program. Content submitted under the Decentralized Press byline is treated as a voluntary donation of authorship to that organization and is not revocable once published.
7. Broadcast Content License
When you submit content to the “Broadcast to All Users,” “Anonymous,” or “Decentralized Press” categories, you grant BonJourno a perpetual, irrevocable, worldwide, fully paid, royalty-free license to:
- edit, modify, fact-check, headline, re-headline, excerpt, summarize, and adapt the content for news presentation;
- distribute, syndicate, promote, archive, and rebroadcast the content across all BonJourno Services;
- publish the content on the homepage, email digests, push notifications, RSS feeds, partner aggregators, and future distribution channels.
Broadcast content may be edited for clarity, grammar, objectivity, bias reduction, accuracy, tone, structure, or any editorial purpose we deem consistent with professional news standards.
This perpetual license applies only to Broadcast, Anonymous, and Decentralized Press content. Content submitted to “My Subscribers” is not edited but may be removed for violations.
8. AI-Assisted Features and Synthetic Media
AI-assisted writing and image tools may send the instructions and content you choose to submit to an AI service provider. AI output may be inaccurate, incomplete, biased, or similar to existing material. You must review the output before publishing it.
You may not upload or generate:
- AI-generated nudity or sexual content;
- synthetic sexual imagery;
- deepfake sexual content;
- synthetic impersonations of real individuals without permission;
- AI-generated content that violates law or rights.
BonJourno may label, restrict, or remove synthetic media.
AI providers may store or process prompts or output as part of their service. BonJourno is not responsible for errors or omissions in AI output.
9. Communities, Chats, Forms, and Petitions
Community owners and administrators may manage membership, posting access, and community content.
Messages and community content may be stored by BonJourno and are not represented as end-to-end encrypted. Disappearing messages control product retention behavior but do not prevent copying.
Form creators are responsible for lawful data collection and deletion. Petitions are user-created expressions; BonJourno does not verify statements or guarantee legal effect.
10. Prohibited Conduct
You may not:
- violate law or another person's rights;
- publish nudity or sexual content (including AI-generated nudity);
- impersonate a person or organization;
- publish plagiarism or unauthorized content;
- threaten, harass, exploit, stalk, dox, or promote hatred or violence;
- distribute malware, spam, scams, or deceptive content;
- attempt unauthorized access to accounts or systems;
- scrape, reverse engineer, overload, or interfere with the Services;
- use automated systems without permission;
- collect personal information for unlawful purposes;
- submit false reports or abuse moderation systems;
- request passwords, private keys, or seed phrases.
BonJourno does not monitor all content and does not guarantee that all violations will be detected.
11. File Uploads and Safety
You may upload files only if you have rights to them and they comply with these Terms.
You may not upload files that:
- contain nudity or sexual content (real or AI-generated);
- depict minors in sexualized or exploitative ways;
- contain graphic violence or disturbing imagery;
- contain malware or harmful code;
- infringe copyright or create derivative works without permission;
- violate law.
BonJourno may scan, flag, restrict, or remove files and may suspend accounts that repeatedly violate rules.
12. Child Protection and CSAM
BonJourno has zero tolerance for child sexual abuse material (CSAM), child exploitation, or any sexualized depiction of minors, including AI-generated or synthetic content.
BonJourno will:
- remove such content immediately;
- suspend or terminate accounts involved;
- report content to appropriate authorities as required by law.
13. Moderation, Reports, and Appeals
Users may report content. We may review reports, limit visibility, label, edit for safety, remove content, restrict features, suspend accounts, preserve evidence, and cooperate with authorities.
You may appeal certain enforcement actions where available. Appeals do not guarantee reversal.
Content may be preserved for legal holds, investigations, or law-enforcement requests.
14. Copyright Takedown Policy (DMCA)
If you believe content infringes your copyright, email support@bonjourno.com with:
- your contact information;
- identification of the copyrighted work;
- identification of the infringing content;
- a statement of good-faith belief;
- a statement under penalty of perjury that the request is accurate;
- your signature.
BonJourno may remove content upon receiving a valid notice.
Users may submit counter-notices. Repeat infringers may have accounts terminated.
15. Third-Party Services and External Content
The Services may include links, embeds, sign-in providers, GIF search, market or crypto information, feeds, and other third-party services. BonJourno does not control or endorse third-party services.
We are not responsible for their availability, accuracy, security, terms, or privacy practices.
16. Advertising, Commercial Use, and Sponsored Content
Users must disclose sponsored content, paid promotions, affiliate links, or commercial relationships when posting promotional material.
BonJourno may label or restrict commercial content.
Users are responsible for any taxes or fees associated with commercial activity.
17. Account Deactivation and Deletion
You may deactivate or delete your account. Deletion is irreversible once started. Some content may remain where legally required or where other users’ content depends on it.
18. Governing Law, Arbitration, and Class-Action Waiver
These Terms are governed by the laws of the State of Wyoming, excluding its conflict-of-law principles.
18.1 Informal Resolution
Before filing any formal claim, you agree to contact BonJourno at support@bonjourno.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute in good faith within 30 days.
18.2 Mandatory Individual Arbitration
If a dispute is not resolved informally, it will be resolved through binding individual arbitration. You and BonJourno agree that:
- arbitration is the exclusive method of resolving all disputes arising from or relating to these Terms or the Services;
- arbitration will be conducted on an individual basis only;
- class actions, class arbitrations, and representative actions are not permitted;
- the arbitrator has exclusive authority to resolve all disputes relating to interpretation, applicability, enforceability, or formation of this arbitration agreement.
18.3 Arbitration Rules and Forum
Arbitration will be administered by a recognized arbitration provider applying its consumer arbitration rules. The arbitration provider and rules will be selected by BonJourno and disclosed to you before arbitration begins. If the provider is unable or unwilling to administer the arbitration, the parties will mutually select a substitute provider.
Arbitration will occur in Wyoming or remotely, at your election.
18.4 Exceptions
This arbitration agreement does not require arbitration of:
- claims that cannot be arbitrated as a matter of law;
- claims for injunctive relief relating to intellectual property rights;
- claims brought in small-claims court, if eligible.
18.5 Opt-Out
You may opt out of mandatory arbitration within 30 days of accepting these Terms by emailing support@bonjourno.com with your name, the email associated with your account, and a clear statement that you wish to opt out of arbitration.
18.6 Survival
This arbitration agreement survives termination of your account and termination of the Services.
19. Suspension and Termination
We may suspend or terminate access if we reasonably believe you violated these Terms or created risk or legal exposure.
Sections that by their nature should survive termination-including ownership, licenses, disclaimers, limitations, indemnity, arbitration, and legal compliance-will survive.
20. Data Retention and Storage
BonJourno may retain:
- backups;
- moderation evidence;
- safety-related data;
- legal-required records.
Retention periods vary by category and legal requirements.
21. Security Practices
BonJourno uses reasonable security measures including rate-limiting, credential protection, automated abuse detection, and secure storage practices. No system is perfectly secure.
22. Disclaimers
The Services are provided "as is" and "as available." We disclaim implied warranties to the fullest extent permitted by law.
We do not provide professional advice. User content is not professional advice. You rely on content at your own risk.
23. Limitation of Liability
To the fullest extent permitted by law, BonJourno is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
Any liability is capped at the greater of USD 40 or the amount paid by the user.
24. Indemnity
You agree to defend, indemnify, and hold harmless BonJourno from third-party claims arising from your User Content or violations.
25. Export Controls
You may not use the Services in countries or regions subject to U.S. embargoes or export restrictions. You must comply with all applicable export laws and regulations.
26. Changes to These Terms
We may update these Terms. Continued use after updates means you accept them.
27. General Terms
If part of these Terms is unenforceable, the rest remain effective.
Failure to enforce a provision is not a waiver. Rights may only be waived in writing.
These Terms constitute the entire agreement between you and BonJourno and supersede prior agreements.
You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets.
